Community Development District
The regular meeting of the Board of Supervisors of the Colonial Country Club Community Development District was held on July 28, 2025 at 2:01 p.m. in a Ballroom of the Colonial Country Club at 9181 Independence Way in Fort Myers, Florida, and also via web conference.
Supervisors present and constituting a quorum:

The following is a summary of the actions taken at the Colonial Country Club Community Development District (CDD) Board of Supervisors meeting.
FIRST ORDER OF BUSINESS Call to Order and Roll Call
The Colonial Country Club Community Development District Meeting was called to order at 2:01 p.m., and District Manager Cal Teague called the roll. Four Board members were present and constituted a quorum. Supervisor Worthington attended remotely and was allowed to participate by vote of the Board. Also in attendance were District Manger Teague and District Manager Rainwater. Client Services Manager Christopher Dudak, attended remotely.
On MOTION by Chair Hefti, seconded by Supervisor Klein, with all in favor, the Board approved Supervisor Worthington’s remote participation in the meeting.
SECOND ORDER OF BUSINESS Approval of the Agenda
On MOTION by Vice Chair Scuderi, seconded by Supervisor Worthington, with all in favor, the Board approved the Agenda as presented.
THIRD ORDER OF BUSINESS Audience Comments on Agenda Items
There were no Audience comments on Agenda items.
FOURTH ORDER OF BUSINESS Approval of Meeting Minutes
A. Draft Regular Meeting Minutes for for June 23, 2025
Supervisor Klein had a question on line 57 of the draft meeting minutes, regarding Gonzalo Ayres’s statement that he was concerned about the availability of workers due to ongoing ICE raids; he asked why this would be an issue since the district utilizes E-Verify. Client Services Manager Dudak explained that, although the district and its vendors only use a work force who have been run through E-Verify, the ICE raids put pressure on the overall labor force, reducing the availability of all workers, whether documented or not.
On MOTION by Vice Chair Scuderi, seconded by Chair Hefti, with all in favor, the Board approved the Draft Regular Meeting Minutes for for June 23, 2025, as presented.
FIFTH ORDER OF BUSINESS Old Business
A. Master Board Rules on Managing Pool Discharges Update
Chair Hefti reported that this wasn’t discussed at the July Master meeting, and it was not on their agenda. This will be left on the agenda for now, and Chair Hefti will follow up with Colonial Country Club General Manager Rob Podley on this.
SIXTH ORDER OF BUSINESS New Business
A. Fiscal Year 2026 Meeting Schedule
i. Discussion on Location and Time Change
For the rest of Fiscal Year 2025, the Board will meet in the Colonial Country Club Ballroom at 9181 Independence Way. Starting in October, the meetings will be held in the Media Room of the same building, and they will start earlier at 1 p.m.
ii. Resolution 2025-03 to Adopt Schedule
This schedule was approved with the single change that the second ride around will be on for September 23, 2025 at 8 a.m. The meeting schedule will be advertised and sent to the city and county as required by Florida Statutes.
On MOTION by Supervisor Zajac, seconded by Supervisor Klein, with all in favor, the Board approved Resolution 2025-03 which adopts the Fiscal Year 2026 meeting schedule.
SEVENTH ORDER OF BUSINESS District Manager
A. Financial Report for June 2025
On MOTION by Supervisor Klein, seconded by Supervisor Zajac, with all in favor, the Board accepted the June 2025 Financial Report, as presented.
B. FY 2026 Budget Discussion
District Manager Teague reminded the Board that the Fiscal Year 2026 Budget Public Hearings are on August 25, 2025.
District Manager Teague presented a handout from Larry Dillard, the president of Preserve at Colonial Recreation Association, about a drinking fountain on the loop path around the preserve. Mr. Dillard asked about a letter received from City of Fort Myers utilities department stating that the drinking fountain water line requires a backflow preventer. Mr. Teague stated that the Master would be required to put it in, and he stated that he will inform the Recreation Association about it.
EIGHTH ORDER OF BUSINESS Field Manager
A. Current Field Inspection Report
The Field Report was presented, and the following were discussed:
- District Manager Teague noted that there is damage to CDD property from the Club’s golf course renovations: silt barriers failing, turbidity curtain failing, and silt in gutter pans.
- Page 41 section f: Vice Chair Scuderi questioned if the photos in the field report of the before and after pictures of the washout repair were of the same area. The location was verified utilizing GIS.
- At the NPCC meeting that Chair Hefti attended, they said that the aerator on Lake 31 was moving. Field Manager Pepin and the Chair have looked and there is no evidence of this.
- The Lake 21 fountain was still down, and Premier Lakes have ordered parts for it. The Board may suggest not replacing it, as the local neighborhood HOA bought it but the CDD maintains it.
B. Follow-up Items
i. Lake 11 Shoreline Restoration Update
Field Manager Pepin stated that the shoreline work is done, but there are several broken slabs of cart path concrete in the area, which Patrick Tohill believes Pristine Lakes damaged by riding over them. Field Manager Pepin has seen heavy equipment from the golf course renovation project driving on these areas, and he says that he was told that they were also driving on the same cart path where the damages are while the bank was being restored. Pristine Lakes told Mr. Tohill that they will have the concrete panels replaced at a cost of $2,000, instead of utilizing Mt. Tohill’s contractor who wanted to charge Pristine Lakes $7,000 for the work. District Manager Teague stated that the damage is on the original concrete of the cart path and looks to be about 800 square feet. Supervisor Klein suggested that the Field Manager should take pictures of all the damaged cart paths in that area and get a firm report with square footage listed out, and then get Pristine Lake’s proposal, so that all of the information is together.
ii. Lake 22 Sod Repairs Update
Field Manger Pepin stated this should be completed by the end of the month.
iii. Stormwater System Cleaning Pipes between 3-4, 5-6, 151-150, and 185-184
Field Manager Pepin stated that Extreme Divers is still behind schedule. He anticipates that the cleaning will be completed sometime in August.
iv. Butterfly Garden Improvements
Field Manager Pepin stated that all the small plants have been planted. Pristine Lakes will be returning this week to plant the larger plants and to put down mulch.
v. Catch Basin Grate on Colonial Country Club Blvd and Hemmingway Ln
Field Manage Pepin stated that the concrete collar was ground down on July 22, 2025, and the grate installation should hopefully be done within the next two weeks.
vi. Lake 31 Aerator Free of its Mooring
Field Manager Pepin stated that he checked this air station a couple of times and it is not moving. This was discussed earlier.
C. Project Tracking Logs
Supervisor Klein asked to know what the is process for approval of cost overruns. District Manager Teague explained that he would consult the Chair, and they can make approvals outside of meetings. Changes like this should be ratified at the next meeting.
NINTH ORDER OF BUSINESS Attorney
There was no report from the Attorney.
TENTH ORDER OF BUSINESS Engineer
There was no report from the Engineer.
ELEVENTH ORDER OF BUSINESS Supervisor Requests/Comments
- Supervisor Zajac noted that on Sky View Way, there are Oak trees that are leaning over the lakes. He asked if the Oaks blow over into the lakes, is CDD responsible for them. District Manager Teague noted that the CDD would be responsible to remove them. Supervisor Zajac asked if it would be prudent to trim the Oak trees, and Vice Chair Scuderi said that the community is trimming them.
- Chair Hefti reported on her the Neighborhood Presidents Communication Committee (NPCC) meeting she attended with District Manager Teague on June 26, 2025 as representatives of the district. They talked with the committee for 45 minutes and there was a lot of engagement on aerators and the fountain.
