THIRD ORDER OF BUSINESS Audience Comments on Agenda Items

Resident Dave Kozy questioned responsibility for the drainage improvements near Lake 22, including project oversight, communication, maintenance, and potential costs to Jasmine Point homeowners. He cited a recent erosion control project that resulted in damage to fiber-optic lines and expressed concerns regarding coordination among the HOA, REC Board, and CDD.

Vice Chair Scuderi stated that the lake banks are owned by the CDD and noted that erosion-control measures have been in place for many years. Supervisor Klein advised that CDD Rule 10-1 addresses the applicable procedures and responsibilities. The ARC Committee previously declined the request to incorporate Rule 10-1 into the last round of revisions, and the CDD Board did not push back on the decision of the Committee. District Manager Cal Teague explained that the District maintains an erosion-control plan and that Field Manager Pepin monitors lake bank erosion on a monthly basis.

Following extensive discussion, Supervisor Worthington suggested that when concerns or potential violations arise, affected parties be notified and invited to attend a Board meeting so the matter can be reviewed and explained. Staff can provide Mr. Kozy with erosion plan information if requested.

Kyle Roehm of Fountain Kings reviewed the aeration repair proposals and explained that the recommended repairs include replacement of aging components identified during routine inspections. He noted that while Chair Hefti inquired about replacing a fountain rather than repairing it, the proposed repairs and new lighting would effectively restore most of the system, leaving only the float and display head as original components. The Board discussed the condition of the aeration equipment and repair options.

On MOTION by Supervisor Zajac, seconded by Supervisor Klein, with all in favor, the Board approved the Fountain King proposal QU-0876 for Fountain #22 repairs in the amount of $9,381.50.
